HanuPay Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the HanuPay mobile application, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Definitions

• "Company" refers to HanuPay, its parent, subsidiaries, and affiliates.
• "Service" refers to the HanuPay mobile application, website, and all related services.
• "User" refers to any individual who accesses or uses the Service.
• "Account" refers to the User's registered profile on the Service.
• "Transaction" refers to any payment, transfer, recharge, or bill payment made through the Service.

2. Account Registration and Eligibility

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

You must be at least 18 years old and capable of forming a binding contract to register for an account. By registering, you represent and warrant that you meet these requirements.

3. KYC and User Verification

To comply with regulatory requirements, we may require you to complete Know Your Customer (KYC) verification by providing:

• Government-issued identification documents
• Proof of address
• Biometric information
• Any other information required by applicable laws and regulations

You agree that we may verify this information with third-party service providers and government databases. Failure to complete KYC verification may result in limitations on your use of the Service or account suspension.

4. Service Usage and Restrictions

When using our Service, you agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate any regulations, rules, or policies of the Reserve Bank of India or other regulatory authorities
• Infringe upon or violate the intellectual property rights of others
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to reverse engineer, decompile, or disassemble any portion of the Service
• Use the Service for money laundering, terrorist financing, or other financial crimes
• Create multiple accounts for fraudulent purposes
• Provide false or misleading information
• Use the Service to conduct transactions related to illegal goods or services

5. Transactions and Payments

By using our payment services, you acknowledge and agree that:

• You are authorized to use the payment method you provide
• You are responsible for verifying transaction details before confirming any transaction
• Once confirmed, most transactions cannot be reversed or cancelled
• We may impose transaction limits based on regulatory requirements or risk assessments
• We may delay or reject transactions that appear suspicious or violate our policies
• Transaction fees may apply and will be disclosed before you confirm a transaction
• Exchange rates for currency conversions will be displayed before transaction confirmation

6. Wallet and Account Balance

Regarding your HanuPay wallet:

• Funds in your wallet are held in accordance with applicable regulations
• Wallet balances do not earn interest
• We may set maximum wallet balance limits in compliance with regulations
• Wallet transfers to bank accounts may be subject to processing times and fees
• Inactive wallets may be subject to dormancy procedures as per regulations
• We reserve the right to freeze wallet balances in cases of suspected fraud or compliance issues

7. Intellectual Property

The Service and its original content, features, and functionality are owned by the Company and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not:

• Use our trademarks, logos, or service marks without prior written consent
• Copy, modify, distribute, or create derivative works based on our content
• Use any content or data from our Service for commercial purposes without permission
• Remove any copyright, trademark, or other proprietary notices

8. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Service, you consent to the data practices described in our Privacy Policy.

9. Service Modifications and Interruptions

We reserve the right to:

• Modify, suspend, or discontinue the Service (or any part thereof) at any time
• Change fees or charges for using our Service with prior notice
• Limit availability of the Service to any person, geographic area, or jurisdiction

We will not be liable for any modification, suspension, or discontinuation of the Service. We do not guarantee that the Service will be available at all times without interruption.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our liability for any claim arising out of these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim
• We are not liable for any loss or damage resulting from your failure to comply with these Terms
• We are not responsible for the actions, content, information, or data of third parties
• We are not liable for any loss of profits, data, or goodwill, or for any system failures or service interruptions

11. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws, rules, or regulations

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of applicable laws or regulations
• Engaging in fraudulent or suspicious activities
• Upon request by law enforcement or regulatory authorities
• Extended periods of inactivity

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the Service shall:

• First be attempted to be resolved through good-faith negotiations
• If negotiations fail, be submitted to arbitration in accordance with the Arbitration and Conciliation Act, 1996
• Be conducted by a single arbitrator appointed by mutual agreement
• Take place in Bangalore, Karnataka, India
• Be conducted in English

The decision of the arbitrator shall be final and binding on both parties.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes through the Service or by other means. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.
